TERMS AND CONDITIONS OF ENTRY

  1. Information on how to enter the Twinings Design Contest above forms part of the terms of entry. Entry into the competition is deemed acceptance of these terms and conditions. This competition is a game of skill and there is no element of chance in the determination of the winner.
  2. Entry is open to all students enrolled in the participating universities in the Philippines, aged 18-25 years old as at the date of entry (“Participant”). Employees of AB Food and Beverages Philippines, Inc., Mckenzie Distribution Company Inc. and agencies and companies associated with this competition and their immediate families are not eligible to enter.
  3. The competition concludes on October 15, 2018 at exactly 11:59:59pm. Public vote will be open until October 15, 2018 and the announcement of winners will be on October 20, 2018 at https://www.facebook.com/TwiningsPhilippines/.
  4. To enter, Participant must log onto www.twiningsdesign.com (“Competition Website”) and register their details including (but not limited to): full name, date of birth, email address, postcode, contact telephone number, name of faculty and university. Participant must also upload their packaging design for the Twinings tumbler template and send the designs in 2 parts 1) in the tumbler shape and 2) in the whole design so that the committee can see the whole picture.
  5. The competition task is to design a packaging to be used for the new “Twinings London Cool Luxe tumbler collection” using the design brief provided on the competition website. All entries must comply with Design Specifications, as provided on the Competition Website. The maximum file size for submission is 5 MB. Packaging designs must be submitted in high resolution pdf format or eps Illustrator file.
  6. Participants can submit as many designs as possible but only one (1) prize per person will be awarded.
  7. The judges’ decision is final and no correspondence will be entered into.
  8. Entries must be the Participant’s own unrealised or realised original design. Each Participant hereby warrants that he/she is the original author of his/her own entry and is legally entitled to assign all right, title and interest in his/her entry to the Promoter (as defined in clause 31). The Promoter reserves the right to verify the validity of entries and to disqualify any Participant who tampers with the entry process, who submits an entry that is not in accordance with these Terms & Conditions of Entry or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. The Promoter reserves the right to disqualify a winner if Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause.
  9. Entries must be received by or before October 15, 2018 at 11:59pm. The time of entry will in each case be the time the data for the entry is received by the Promoter. The Promoter accepts no responsibility for any late, lost or misdirected entries including entries not received by the Promoter or delays in the delivery of the entry due to technical disruptions, network congestion or for any other reason.
  10. The cost of accessing the Competition Website will be dependent on Participant's individual internet service provider. Any costs associated with creating the entry are at the cost of Participant.
  11. The winning design is intended to be the basis for the Twinings London Cool Luxe tumbler collection packaging. The Promoter however is under no obligation to use the design for the final packaging of the collection, and is under no obligation to continue usage of this design for the duration of the Twinings London Cool Luxe tumbler collection in market. The Promoter reserves the right to change, modify, and adapt all entries in any way for printing purposes or otherwise.
  12. Major prizes are:
    • Winner: trophy with cash prize of 50,000 Pesos (Faculty / University: cash prize 20,000 Pesos)
    • 1st runner up: cash prize 30,000 Pesos (Faculty / University: cash prize 10,000 Pesos)
    • 2nd runner up: cash prize 10,000 Pesos (Faculty / University: cash prize 5,000 Pesos)
    • Popular vote: cash prize 10,000 Pesos
  13. Total prize pool value is 135,000.00 Pesos
  14. The winners shall be responsible for all taxes arising from accepting the prizes including but not limited to the final withholding tax of 20% which will be withheld by the Promoter as provided by law for cash prizes above 10,000 Pesos. The withholding tax is only applicable to prizes won by individuals.
  15. A judging panel will review all entries submitted by the date stipulated in clause 3. All winners will be determined on October 15, 2018. Judging will be in line with the criteria stipulated in the design brief, as accepted and downloaded by all Participants on the Competition Website.
  16. Criteria for judging the contest:

    2) Design is matched to the theme

    3) Overall impact

    4) Vote from public
    10%
    Note: Popular vote prize criterion is 100% and will come from the votes of the public. The method for converting the votes into scores shall be at the discretion of the Promoter which shall be fair and transparent.
  17. The winners will be contacted in writing, via email and/or phone call within two days of determining the winner. The winners’ details will be published on the Competition Website on October 20, 2018.
  18. Should the promoter decide to hold an awarding ceremony to announce the winners, all prizes shall be distributed during the said event. Participants who will not be present during the awarding ceremony can claim their prizes as stipulated in Clause 19. The awarding ceremony and venue will be announced by the Promoter via Facebook.com/TwiningsPhilippines at least a week before the awarding ceremony, or on October 10, 2018.
  19. The winners must claim their prizes not later than November 9, 2018 at the office of AB Food & Beverages Philippines, Incorporated, located at 2/F, Valiant Building, #86 E. Rodriguez Jr. Avenue, Ugong Norte 3, Libis, Quezon City. If any of the prizes remain unclaimed until November 9, 2018, then the prizes will be forfeited (the faculty / university of the winner will not get the prize as well). The winning design/s will remain to be the property of the Promoter and can be used for the Twinings London Cool Luxe tumbler collection packaging if they so wish but are not obligated to otherwise, and the winner will not be entitled to any fee for such use.
  20. In consideration for the Promoter awarding the prize to the winner, the winner hereby assigns to the Promoter all right, title and interest in and to all copyright in any material created pursuant to the winner's design entry and participation in any aspect of the prize (Works). The winner acknowledges that the Promoter is free to use the Works and to exercise its rights in relation thereto and the winner will not be entitled to any fee for such use. In consideration for the Promoter offering each Participant the opportunity to compete, each Participant hereby assigns to the Promoter all right, title and interest in and to all copyright in any material created pursuant to Participant’s entry (“Work”). The Participant acknowledges that the Promoter is free to use the Work and to exercise its rights in relation thereto and the Participant will not be entitled to any fee for such use.
  21. In consideration for the Promoter awarding the prize to the winner, the winner hereby permits his/her design, personal details (name, age, postcode), image and and/or voice, as recorded, photographed or filmed during the winner's participation in the contest to appear in connection with the Promoter’s advertising or marketing, in any media whatsoever throughout the world and the winner will not be entitled to any fee for such use.
  22. By entering the competition, the Participant acknowledges that his/her submissions may be displayed on the Competition Website available for viewing by the public. The Promoter reserves the right to access and correct or edit text in the Participant’s submission prior to publication on the Competition Website.
  23. By accepting the prize, the winner agrees to participate in and co-operate as required with all reasonable media editorial requests relating to the prize and the contest, including but not limited to, being interviewed, and photographed or filmed.
  24. Once prizes have left the Promoter's premises, the Promoter takes no responsibility for prizes damaged, delayed or lost in transit.
  25. All other expenses incurred by participating in the contest become the responsibility of the winner.
  26. Should the Participant’s contact details change during the promotional period, it is the Participant's responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to Promoter.
  27. The Promoter and its associated agencies and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available.
  28. All entries become the property of the Promoter. The Promoter collects personal information about Participant to enable Participant to participate in this contest but no further use of this information except those stipulated herein will be made without prior consent of the Participant. If, in the future, the designs will be used for another Twinings project, the design owner/Participant will be informed and paid similar to the 2nd runner up prize.
  29. All opt-in entries will be entered into a database and the Promoter may use the Participant's names, addresses and telephone numbers for future promotional and marketing purposes by the Promoter. These details will not be sold or given to 3rd parties. By opting-in, Participant confirms that he/she allows his/her details to be used for this purpose. If Participant no longer consents to his/her details being used for future marketing purposes, the Participant should contact the Promoter on its details set out in clause 31. Any request to update, modify or delete the Participant's details should be directed to the Promoter. By submitting an entry to the contest, the Participant expressly consents to the collection by the Promoter of his/her personal information for purposes of the contest and for future promotional and marketing purposes by the Promoter.
  30. The Participant acknowledges and agrees to comply with these terms and conditions.
